What is a Buyer’s Agent?
A Buyer’s Agent has, without limitation, the following fiduciary duties to the buyer: reasonable care, undivided loyalty, confidentiality, full disclosure, obedience and accounting. The obligations of a Buyer’s Agent are also subject to any specific provisions set forth in an agreement between the agent and the buyer. Home Buyer’s Fidelity’s fiduciary duty is always solely and exclusively to the buyer.
Common Misconceptions… The traditional real estate agency both lists properties and seeks buyers directly. Typically, a buyer calls an agency after viewing a real estate ad. The agent answering the call arranges to show the prospective buyer the property. Often, the buyer assumes this person is his agent. The buyer is wrong. This is the agent of the seller. That agent’s fiduciary duty is to the seller.

Home Buyer’s Fidelity provides buyers with comprehensive consulting and due diligence services, which include determining our client’s particular requirements and desires, locating appropriate residences, making specific recommendations, undertaking research which may provide buyers with a negotiating advantage, developing negotiating strategies and implementing buyer’s instructions, all for the acquisition of a residence in Westchester County.
Our agents work together on behalf of each client. This collaboration sets us apart from traditional real estate agencies. HBF undertakes to obtain information for the buyer, beyond the usual of seller’s original purchase price, date of purchase, current equity, length of time on the market and selling prices of similar homes. We search for information like the reasons for the property coming to market, and the degree of seller’s motivation. Our team works together on each project, and each agent contributing their time, knowledge and experience for the buyer’s benefit. By finding and disclosing all available information about a property and its owner, we aspire to provide our client with a negotiating advantage. Our team strives to present the best properties for the buyer’s consideration and selection, and to close the transaction at the most favorable price and terms possible.
Since Home Buyer’s Fidelity does not accept property listings, and does not represent owners selling residential real property, we avoid a conflict of interest,. By representing buyers only, Home Buyer’s Fidelity has a fiduciary duty solely and exclusively to the buyer, and never to the seller.
